'King Of Pop' Fails To Show For Hearing In N.O. Wed Jul 20, 5:24 PM ET

A judge in New Orleans called pop star Michael Jackson's failure to appear at a Wednesday court hearing a "serious failing" that the court "does not take lightly."

Jackson was ordered to appear for a hearing in a sexual assault lawsuit, but neither he nor his attorneys showed up.

Attorneys for the local man who said Jackson attacked him 20 years ago said they now hope for a fast settlement.

Joseph Thomas Bartucci alleges he was sexually assaulted by the singer at the World's Fair in New Orleans when he was 18. Bartucci said he didn't come forward until 2003 because he had suppressed memories of the alleged attack.

"He was drugged and sexually abused," said plaintiff psychologist Mulry Tetlow. "Jackson cut his arm and was licking his blood as Jackson was sexually abusing him and stuck a wire into his chest, and he has scars there."

Judge Eldon Fallon said the order to appear in court was received and signed at Neverland Ranch.

Fallon on Wednesday set a new hearing date in August.

And if he doesn't show then?

"Then it will be like a jury verdict holding him liable, and the next thing we have to do is we present evidence to the court on the amount of damage that's been caused," said Bartucci's attorney, Louis Koerner.

Bartucci's lawyers said they could seek as much as $30 million.

Jackson's Houston-based attorney, Michael Sydow, told WDSU NewsChannel 6 that Jackson has been out of the country and they were not aware of the order to appear. Sydow said Jackson's team will vigorously defend the case, and that Jackson would be "well represented during next month's hearing."
